If you aren’t going to offer your back catalog of games to people in a reasonably accessible, complete fashion that also justifies not emulating, people are going to emulate. I say this as both an emulation enthusiast and someone who happily buys any remasters/remakes put out on both Switch and other platforms, but in a lot of cases it simply isn’t an option. I basically owe my interest in retro gaming to emulation because there were just too many games Nintendo and others refused to make available in an official format where I would’ve bought them, or in a manner that made emulating the original game obsolete.
I was there day one for Prime Remastered after years of playing PrimeHack, and Remastered was so good that it’s basically the only way to play the game now for me. I bought Samus Returns at launch despite openly supporting efforts like AM2R. I bought both No More Heroes games physically on Switch after basically only ever being able to play the game through Dolphin. I just restarted my Switch Online subscription WITH the Expansion for GBA stuff, and most of these games I’ve been playing through emulation for years.
We will be there when Nintendo makes just buying the games like normal or in a better form an option. There’s a lot of stuff in their library I’d love to play on Switch, but until then, it’s the seven seas because Nintendo doesn’t want me to. Maybe if I do a fresh playthrough of Path of Radiance/Radiant Dawn on Dolphin I can will into existence an HD remaster that’ll be announced on Twitter alongside that FE4 remake in the style of Echoes we still don’t have

Isn’t the vast majority of Nintendo’s catalog not available?
Even most of the stuff that was available on the Wii U Virtual Console isn’t available on the Switch Virtual Console.
I believe it was Gabe Newell that said “Piracy is almost always a service problem and not a pricing problem.” Nintendo sure as hell has a service problem.

For all the people saying they have no problem with this they are absolutely going to use this for going after older games they no longer sell or make available. They will use this to be as anti preservation as possible. They will also use this to be as anti modding as possible for rom hacks or other mods that need some specific base game to run as well. Being anti mods is anti consumer.

My main problem is that older games are not readily available and buying them is becoming extremely expensive.
For example, if you want to play Hagane on the SNES legitimately your only option is to spend $1000 on a loose cartridge.

There is no stopping piracy, and it is a wasted effort to try. Piracy is a service delivery issue. If a company refuses to offer its products affordably and conveniently, people will find a way to get and distribute them for free. I will pay for products when they are offered reasonably, but I have no qualms about pirating if they aren’t.

Put your retro library up on Switch store or whatever make the old games pre 1995 like a dollar each and just let it go. Most people would pay a dollar over sailing the seas.
