Is it wrong for Nintendo to shut down fan games?



I actually think it’s justified in most cases. Allow me to explain why:

What do you all think? Are there any fan games you really enjoy? Or any that were shut down?

    No its well within their rights to shut down anything that uses their intellectual property.

    If this motivates those people to make original games that they actually can sell and improve their careers, I’m all for it. I love indie games inspired in my favorite Nintendo series (Hollow Knight, Bug Fables, Kaze and the Wild Masks…)

    I still don’t get why these devs keep making Fan Games knowing damn well that they are infringing IP copyright and they will get shutdown at any moment.

    Honestly, much of the stuff people rant on in regards to Nintendo’s history with fan games is really overblown. Many fan games still exist to this day with no problem.

    Most of Nintendo’s targets tend to be either games that potentially conflict with their own (like how the fan Metroid 2 remake was shut down around the time Nintendo announced Samus Returns) or games that use modded content.

    As for my own views, I can’t say I don’t understand. I don’t play fan games for the most part, but I can understand the potential frustration when much of the news regarding Nintendo and fan games tends to be negative.

    For better or worse, Nintendo is extremely protective of their IP’s, and that kind of is something we need to accept.

    No and I don’t feel sorry for anyone that chooses to go down that route and Nintendo comes knocking. It’s well known Nintendo doesn’t mess around with its properties. It’s foolish to keep doing it expecting a different result.

    Like what if I made a porn game with Mario. Nintendo should be able to protect their property if they want.

  9. Anyone who agrees with this take, please tell me why it’s ok for projects like Black Mesa to exist, but it’s not ok for Pokemon Uranium to exist. 

    Bear in mind that I don’t particularly care about legality, only morality. Just because a company is following the law doesn’t make it right. 

    Also note that Black Mesa was in development and playable for years before it was hosted on Steam directly.

    It’s within their right to do so, but as someone who really enjoys playing fan games and wants to make one one day, it’s a shame many devs are so against them. Again, it makes sense why, but if they aren’t profiting off the games, then who really cares, you know?

    Legally, it’s perfectly correct and justified.

    Morally, not everyone is gonna agree. I say it’s morally wrong of them to take down fan games, and I *feel* like most reasonable minds would agree, but there are plenty of people who defend Nintendo as well so..

    No, protecting IPs means Also for example preventing the misuse of the IP itself, theres a good reason for example that Capcom had aggresively adding denuvo even retroactively to all its Games and its banning mods for them (Because an accident with a Street fighter tournament with a nudity mod applied)

    Also a Big no that many people seems to fail at understanding is comercial mods or fangames of any kind is a Big no to ANY developer (even with Sega Who allows any fangame ever created as long as its non comercial)

    Now, just because Nintendo is not wrong in protecting their IPs from misuse or others gaining money from It It means they should shut them ALL? Maybe not, i think It should be a project to project basis
