I bought this card direct from tcg player described as near mint. Comes in today in a penny sleeve, no top loader. Would you guys consider this near mint and should I bother trying to return it?

No. That is ragged. Return it
Def not, is it worth the hassle or a much needed review from their apparent poor integrity or packaging. Top loaders aren’t that expensive especially for what you probably paid..
Damn. That has enough damage on top to not even be considered mint.
If paid too much- return it, if not, give seller bad rating unless he had shown a picture of it like this. However, it is a bubble mew….even in that condition, it will age well down the line. Good luck.
Tgcplayer explains the rating systems and defines what different types of damages are. The back top looks like a type of fault:
*Terms: Rippling, Drips/Drops, Fraying, Peels*
**Slight** – Up to 2.5mm² in area. Slight Fault cannot be accepted at a condition higher than Moderately Played.
I’ve never boughten from tgcplayer but if it came like that and was advertised as near mint i would try to get my money back.
