    But to answer your question I’m sure they got approval from Nintendo in some way even if its not public

    Don’t very much see the point. Seems like a lot of effort to expend to claim right over decade old music.

    Surely Nintendo has the right to sue, but it’s really not worth the legal costs. Especially since NO ONE will be playing a government made recycling game…

    In the 90’s Nintendo and Joseph Lieberman waged a smear campaign against Nintendo’s biggest rival Sega, setting off a series of events that eventually led to Sega getting out of the console market.

    This was a low-budget game that was made by some part of the government who outsourced it to the cheapest bidder. The bidder grabbed the mp3 knowing that no one would know, collected their paycheque and saw themselves out. It sucks – hopefully they just replace the mp3 file.

    What are some good cases in which Nintendo did not sue for copyright material? Project M never got sued, right? Pokemon Uranium got shut down same as Metroid AM2R. I know these are a lot bigger than using some music, but Nintendo is certainly known to be pretty strict on this stuff.

    If they didn’t have permission, I hope Nintendo do say something. A US government contractor should know better.

    I’m an indie game developer working on a shoe-string budget and I take great care to make sure I credit my sources and check the terms of all my assets. I value the contributions of others and It isn’t difficult.

    If the government isn’t making money off of selling the game, I’m not sure there are any damages to sue for?

    They removed the music from the game as of now, but it seems they did it poorly, since the file is still on the server and the game gives me JavaScript errors due to not being able to find a song to play in game.

    Still, it’s amusing that Yoshi’s Island DS music made it into a game like this. Such a random, obscure choice to be honest.
